Indicators of GDPR non-compliance
- GDPR Art. 6(1)(f), TKG § 165INFOnline (script.ioam.de) loads at +1648 ms and sends two tracking pings at +2518 and +2934 ms. The Cookiebot banner only completes initialization and logs consent at +5186 ms. INFOnline runs before the user could have accepted or declined anything.
Context
Bauforum24 is an Austrian online portal for the construction industry (news, video, forum). HAR: 83 requests, 8 domains. Runs its own advertising system, Revive Adserver (ads.bauforum24.biz), and is a member of IVW.
INFOnline before the banner
The Cookiebot CMP loads at +1604 ms and logs the user’s consent at +5186 ms. Within this interval INFOnline manages to load (+1648 ms) and send two tracking pings (+2518 and +2934 ms). The gap between INFOnline’s first ping and the consent logging is 2.6 seconds. The policy justifies INFOnline via legitimate interest (Art. 6(1)(f)) — but this does not exempt it from the TKG § 165 requirement, which mandates consent for any identifier stored on a device.
Proprietary advertising, no third parties
ads.bauforum24.biz — Revive Adserver (open source), a self-hosted advertising system. Banners load from a proprietary subdomain after Cookiebot. No Google, Meta, or programmatic ad networks.
Conclusion
Cookiebot is present, declarations are present, advertising is self-hosted — architecturally not bad. But INFOnline runs before the banner, and this is a direct contradiction between the declared scheme and the actual sequence of events.
